Website World: Terms of Service & Hosting Agreement

This Agreement is made between Website World Communications ("Website World"), located at PO BOX 34065, Knoxville, TN 37930, and the Customer. By uploading files, storing data, or utilizing any services provided by Website World, you agree to be bound by the following terms.


1. FEES, BILLING, AND PAYMENTS

  • Billing Cycle: All service fees are billed in advance on a quarterly or annual basis.

  • Invoicing: Invoices are sent via email at least seven (7) days prior to the next billing period. Payment is due before the first day of the new period, regardless of holidays or weekends.

  • Setup Fees: A one-time $50.00 setup fee applies to new accounts. This fee is waived for annual prepayments or incoming domain transfers.

  • Overage Charges: * Disk Space: Extra space is billed at $.80/MB per month.

    • Data Transfer: Basic plans include 2.5GB/month. Additional transfer is $.10/MB.

  • Non-Payment: Failure to pay by the due date may result in immediate service suspension. A $50.00 reconnection fee applies to restore suspended accounts. Payments by check for restoration may require a 7–10 day clearing period.

  • Refund Policy: All sales are final. Website World does not offer refunds for web hosting, design, or support services.

2. DOMAIN NAMES & DNS

  • Ownership: Domain names are owned by the Customer. The Customer is responsible for domain registration, renewals, and fees via their preferred registrar.

  • DNS Management: DNS must be managed by Website World. We do not permit third-party DNS or external nameservers to point to our servers.

  • Abandonment: If a domain’s DNS/MX records are pointed away from Website World servers, the account is considered "abandoned." Abandoned files and emails become the property of Website World and are subject to deletion or commercial use (including ad-parking).

3. TECHNICAL SUPPORT & EMAIL

  • Support Protocol: All support must be initiated via email to biddle@websiteworld.com. Please allow 48 hours for a response. Telephone support (865-379-7171) is reserved for issues not resolved via email.

  • Device Configuration: Customers are responsible for configuring their own IMAP/POP3/SMTP devices.

    • Self-Service: Settings are available at websiteworld.com/emailsetup.

    • Webmail: If unable to configure a device, use mail.websiteworld.com.

    • Third-Party Help: Website World does not provide on-site hardware support. We recommend the Apple Store or local IT professionals for device-specific setup.

4. SECURITY & ACCEPTABLE USE

  • WordPress Management: To ensure server integrity, Website World retains Administrator access to all WordPress sites; Customers are assigned Editor roles.

  • Mandatory Tools: Wordfence and Google reCAPTCHA are required on all sites. Use of "Math Captcha" or outdated security methods is prohibited.

  • Prohibited Content: No pornography, pirated software, or mass-marketing "spam" (UCE). Two complaints of unsolicited email in one month will result in immediate termination without refund.

  • Resource Usage: Excessive CPU usage or "hotlinking" (external sites linking directly to your files) is prohibited and may result in immediate suspension.

  • Maintenance: Website World does not guarantee 100% uptime. Sites may be temporarily unavailable during server reboots, security patches, or software upgrades.

5. CANCELLATION & TERMINATION

  • Notice Required: A 30-day written notice is required for cancellation. Requests must be sent to our PO Box or processed via phone at 865-379-7171 with your User ID and password.

  • Data Release: Final invoices must be paid in full before website files or data will be released to the Customer.

  • Post-Cancellation: Any files or emails remaining on the server after the 30-day notice period become the property of Website World.

6. LIMITATION OF LIABILITY & INDEMNITY

  • No Warranties: Services are provided "as is." Website World makes no warranties of merchantability or fitness for a particular purpose.

  • Data Responsibility: The Customer is solely responsible for maintaining their own backups and disaster recovery plans. Website World is not liable for data loss, service interruptions, or delays.

  • Indemnification: Customer agrees to indemnify and hold Website World harmless from any claims, damages, or legal fees arising from the Customer's use of the service.

7. LEGAL VENUE

This Agreement is governed by the laws of the State of Tennessee. Any disputes shall be settled in the state or federal courts located in Knox County, TN. The prevailing party in any dispute shall be entitled to recover reasonable attorney fees and costs.


By uploading or storing files on Website World servers, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
